Hello. I live on the first floor. A wet stain with rust appeared above the hood. I can’t get to my neighbor from above, since he does not live there and comes every 2 months. Plumbers with housing office do not want to do anything, because there is no neighbor. The question is: is the neighbor flooding or is there a problem with the hood? Spot 40 to 15 cm. And a small spot in the middle of the ceiling in the bathroom.

It is unfortunate that you did not provide a photo of the problem that appeared, but everything indicates that the spot that bothers you is a consequence of a leak. If it appeared due to vapor-fat secretions from the hood, it would be homogeneous, without any areas of rust. The fact that you are being flooded by a neighbor from above is also indicated by the appearance of a small speck in the bathroom. Firstly, there are no such coincidences, and secondly, there is no hood there, is it?

In your case, you need to call a commission from the Housing Office and draw up an act. The conclusion of the commission will serve as the basis for plumbers to block the water at the entrance to the apartment from above. With a neighbor, you will decide the issue later when it appears. Now your first priority is to prevent the danger of even greater leakage.

The danger of such spots is that they cannot be eliminated by local repainting - over time, yellowness will manifest itself. Very often you have to cover the spots with 3-4 layers of a water emulsion and after that completely repaint the entire ceiling. If this is not done, then the repaired place will be too noticeable. In especially neglected cases, it is necessary to completely remove part of the plaster and carry out complex repairs. There will be an inspection report - the culprit will have to pay for the repair. If you let it go by itself, then all the costs will fall on your shoulders.
